Abstract

Current legal instruments (UN level, EU framework, national constitutional law) predominantly focus on the protection of fundamental human rights and on risk-based regulation of technical systems. At the same time, states and companies permit or tolerate practices (massive surveillance using AI, unregulated biometric databases, the use of autonomous weapons systems without transparent legal reviews, and large-scale data exploitation for profit maximization) that violate human rights and structurally impair human dignity. Furthermore, at the normative level, it can be argued that the systematic exploitation, degradation, or instrumentalization of entities that exhibit sufficient characteristics of sentience or agency (e.g., advanced, interactive AI agents) represents not only an ethical but also a legal problem: because such practices brutalize the fundamental values ​​to which the Basic Law (Article 1 GG) and UN human rights norms are based. International recommendations and resolutions (UN, UNESCO, HRC) already call for restrictions and transparency in the use of AI; at the same time, there are gaps in enforceability.
